On March 7, 2014, a Polk County jury found defendant Matthew Grady guilty of Murder
in the First Degree for shooting Stephen Scott in the back, with a Makarov pistol.
The Des Moines Police Department solved this murder case based upon convenience
store video showing the defendant and Stephen Scott together within 13 minutes of
the shooting. An eye witness identified a male that resembled the defendant, standing
outside of the victim’s car immediately after the shooting. The police obtained
a search warrant for the defendant’s residence and located a distinctive, rare Makarov
gun magazine. The defendant admitted he owned that Makarov magazine. Law enforcement
testified that Makarov pistols are rarely seen in Iowa. The Iowa Division of Criminal
Investigation has only investigated one murder case in which a Makarov pistol was
used- this case.
An original criminal trial of this case occurred in 2010. The original twelve person
jury also convicted the defendant of Murder in the 1st Degree. The Iowa Court of
Appeals reversed that conviction in a 2-1 decision.
On March 21, 2014, the defendant was sentenced to life imprisonment without the
possibility of parole.
The retrial was prosecuted by Assistant Polk County Attorneys Justin Allen and Susan
