Weekly Case Summary
05/14/2012

On May 14, 2012, Randal Johnston was sentenced for the crime of Conspiracy to Manufacture a Controlled Substance, a Class B felony, as a second or subsequent offender, in case number FE251785. He was sentenced to a maximum indeterminate term of fifty (50) years in prison, consecutive to his parole revocation, and must serve a mandatory one-third term of this sentence prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On May 14, 2012, Christopher Lee Miller pled guilty to Attempted Burglary in the 1st Degree and Willful Injury Causing Bodily Injury. The defendant waived time before sentencing and waived the use of a presentence investigation report. The Court adopted the parties’ plea agreement and sentenced the defendant to prison for a term not to exceed 15 years. The Court also entered a No Contact Order.

On May 14, 2012, Aleisha Robinson was sentenced to an indeterminate term of incarceration not to exceed 10 years in Polk County Criminal Number FECR252795 for the crime of Possesion of a Simulated Controlled Substance with Intent to Deliver (Cocaine). Over the State’s objection, the Court granted Aleisha Robinson a suspended sentence and placed him on probation for a period of two years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On May 14, 2012, Bianca Arreola-Dominguez pled guilty in Polk County Criminal Number FECR254258 to the crimes of Delivery of a Controlled Susbstance (Methamphetamine) and Failure to Possess a Tax Stamp. Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

05/15/2012

On May 15, 2012, defendant Zachary Lollman appeared for sentencing for the crime of Burglary 3rd, a Class D Felony. Mr. Lollman was placed on probation for a period of 2 years and ordered to comply with any required treatment. Defendant was also ordered to maintain full time employment and/or school or a combination of both.

On May 15, 2012, defendant Alecia Huston appeared for arraignment. Pretrial conference was scheduled for June 14, 2012 at 2:00 p.m. in Courtroom 204. Jury trial was scheduled for July 16, 2012 at 9:00 am in Courtroom 204.

On May 15, 2012, defendant James Daye appeared for arraignment. Pretrial conference was scheduled for June 14, 2012 at 2:45 p.m. in Courtroom 204. Jury trial was scheduled for July 16, 2012 at 9:00 am in Courtroom 204.

On May 15, 2012, defendant Christopher Riggs appeared for arraignment. Pretrial conference was scheduled for June 7, 2012 at 1:45 p.m. in Courtroom 204. Jury trial was scheduled for July 16, 2012 at 9:00 am in Courtroom 204.

On May 15, 2012, defendant Jamie Johnson appeared for arraignment. Pretrial conference was scheduled for June 14, 2012 at 2:30 p.m. in Courtroom 204. Jury trial was scheduled for July 16, 2012 at 9:00 am in Courtroom 204.

On May 15, 2012, defendant Christopher West appeared for arraignment. Pretrial conference was scheduled for June 14, 2012 at 2:45 p.m. in Courtroom 204. Jury trial was scheduled for July 16, 2012 at 9:00 am in Courtroom 204.

Melanie Stout pled guilty in FE253890 and FE253882. She admitted she committed an escape when she walked away from the Women’s Residential Facility where she was ordered to reside as a result of being convicted of a felony and was on parole. She also admitted she Violated A Custodial Order when she requested her friend arrange a visit with her son and then failed to return her son to his proper custodian. The Court had ordered removal of the child when Stout fled the Women’s Facility. The custodian agreed to allow a visit but the Defendant then failed to return the child and concealed the child from the custodian, intending to keep him with her without ever returning him. An Amber Alert was issued. The child was safely located and returned. Ms. Stout was sentenced to prison for a term of five (5) years for each offense. These sentences were run concurrent to each other (for a total of five (5)) but were run consecutive to the Conspiracy to Commit a Forcible Felony for which she had already been sentenced. Her parole was revoked as a result of her leaving the Women’s Facility.

On May 15, 2012, Michael Page was sentenced for the crime of Possession of a Controlled Substance With Intent to Deliver, a Class D felony, in case number FE248818. He was sentenced to a maximum indeterminate term of five (5) years in prison, but this sentence was suspended and he was placed on probation. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On May 15, 2012, Anthony Settle was sentenced to an indeterminate term of incarceration not to exceed 15 years in Polk County Criminal Number FECR251063 for the crime of Conspiracy to Deliver a Controlled Substance (Cocaine Base “Crack”) as a Second or Subsequent Offender. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Bobby Palmer Jr. was arraigned in FE255358 on Count I: Eluding or Attempting to Elude a pursing Law Enforcement Vehicle, a Class D Felony; Count II: Operating a Motor Vehicle while Under the Influence of Alcohol, a Serious Misdemeanor. The defendant entered a plea of not guilty to all charges. A pretrial conference and trial date were scheduled.

Jaden Wilder was arraigned in FE252734 on one count of Theft 2nd a Class D Felony. The defendant entered a plea of not guilty to the charge. A pretrial conference and trial date were scheduled.

John Richard Grant III, was arraigned in FE255466 on one count of Burglary 3rd, a Class D Felony. A guilty plea date was scheduled for June 12, 2012 at 9:30am in courtroom 204.

Asif Nadarevic was arraigned in SR255400 on two counts of Possession of a Controlled Substance, a Serious Misdemeanor, and one count of Unlawful Possession of a Prescription Drug, a Serious Misdemeanor. The defendant entered a plea of not guilty to all charges. A pretrial conference and trial date were scheduled.

Thomas Freeland was arraigned in FE255372 on one count of Possession of a Controlled Substance, a Serious Misdemeanor, and one count of Operating a Motor Vehicle while Barred, an Aggravated Misdemeanor. The defendant entered a plea of not guilty to all charges. A pretrial conference and trial date were scheduled.

David Harpin was arraigned in FE255385 one count of Conspiracy to Deliver a Controlled Substance, a Class D Felony. The defendant entered a plea of not guilty to the charge. A pretrial conference and trial date were scheduled.

Robert R. Arends appeared for a pretrial conference in two cases: FE253794 and FE2537795 on Five counts of Forgery in each case. A guilty plea date was scheduled for May 21, 2012.

Hailey Thang appeared for a pretrial conference in FE254353 on one count of Forgery. A jury trial date of July 30, 2012 was confirmed.

Randi Beveridge appeared before the court for sentencing in FE252943. The defendant had previously pled guilty to Theft in the 2nd degree, a Class D Felony on April 5, 2012. The defendant was adjudged guilty of Theft 2nd and received a 5 year suspended sentence. He was placed on probation for 2 years. While on probation, the defendant was required to submit a DNA sample and complete a mental health evaluation and follow all recommendations. The defendant was also assessed a fine in the amount of $750.00 and a 35% surcharge.

Angela Kiefer appeared before the court for sentencing in FE252850. The defendant had previously pled guilty to Theft in the 2nd degree, a Class D Felony on March 29, 2012. The court ordered that judgment in this case be deferred and the defendant was placed on probation for a period of 2 years. The defendant was ordered to pay a civil penalty of 750.00. The defendant was also ordered to complete her GED, obtain a mental health evaluation and follow recommendations, to complete the House of Mercy and follow any recommendations, and reside at the Women’s facility at the probation officer’s discretion based on her progress or lack of progress while on probation.

Raymond Lee Silbaugh appeared before the court to enter a guilty and a request for immediate sentencing in FE238497. At the hearing, the defendant entered a guilty plea to two counts of Forgery both Class D Felonies. In exchange for his guilty plea, two other counts of Forgery were dismissed. The defendant’s plea of guilty to two counts of Forgery were accepted by the Court. The defendant was sentenced to a prison term not to exceed 5 years in prison on each count. The sentences were ordered to run consecutive to each other for a total indeterminate term of incarceration not to exceed 10 years. The defendant was also assessed a fine in the mount of $750 and a 35% surcharge on each count but the fines were suspended due to the defendant’s incarceration. The defendant was also order to submit a DNA sample.

Lanny Whitlatch appeared before the court for a disposition of a probation violation matter in FE230293 and FE208594 after he had previously stipulated that he had violated his probation. In FE208594, the defendant was sentenced to 15 days in jail and subsequently discharged of probation. In FE230293, the defendant was continued on probation subject to all original terms and in addition was ordered to make all appointments with his P.O and continue with his payment plan directly to the Clerk of Court. Bond Review

Ruot Simon Puok appeared for a Bond review in FE255115. The defendant was being held on $50,000 cash only bond. After hearing arguments from both counsels, the bond was changed to $50,000 cash or surety. The court also ordered the defendant may be interviewed RWS program.

05/16/2012

On May 16, 2012 Tisha Wallace appeared for a probation violation hearing. The Court found that the defendant violated her probation and sentenced her to prison for a term not to exceed 10 years.

On May 16, 2012 Melissa Cory was sentenced for committing Theft in the 2nd Degree. The Court granted her a suspended sentence and placed her on probation. Conditions of probation include paying full restitution.

On May 16, 2012 Krista Kirkland appeared for a bond review hearing. The Court modified the conditions of probation to include her being placed on RF monitoring and placed on intensive supervised probation.

On May 16, 2012, Jerry Glenn appeared for a hearing regarding jail credit. The Attorney General’s Office did not receive notice regarding this pending litigation. The Court therefore continued the hearing to June 14, 2012 at 10:30 a.m. Courtroom 204.

On May 16, 2012, Brian Nichols appeared for an Arraignment. The following dates were set: Pretrial conference 6-14-12 at 2:15 p.m. Room 204. Trial date 7-16-12 at 9:00 a.m.

On May 16, 2012, Edward Miller appeared for an Arraignment. The following dates were set: Pretrial conference 6-14-12 at 2:45 p.m. Room 204. Trial date 7-16-12 at 9:00 a.m.

On May 16, 2012, Crystal Purdy appeared for an Arraignment. The following dates were set: Pretrial conference 6-14-12 at 2:00 p.m. Room 207. Trial date 7-16-12 at 9:00 a.m.

On May 16, 2012, Melinda Ebarb appeared for an Arraignment. The following dates were set: Pretrial conference 6-14-12 at 2:00 p.m. Room 204. Trial date 7-16-12 at 9:00 a.m.

On May 16, 2012, Danny Ames appeared for an Arraignment. The following dates were set: Pretrial conference 6-14-12 at 1:45 p.m. Room 204. Trial date 7-16-12 at 9:00 a.m.

05/17/2012

On May 17th, 2012, Rigoberto Camacho FE254263, entered a guilty plea to the offense of Manufacturing a Controlled Substance-psilocybin mushrooms, as alleged in Count I of the Trial Information, in violation of Iowa Code Section 124.401(1)( c )(8), a Class C Felony without the gun enhancement. He waived time and notice and requested immediate sentencing. Both parties recommended a ten year suspended prison sentence and probation. The Defendant was not allowed to ask for or accept a deferred judgment. The Court agreed with the recommendations of the parties and sentenced him to prison for ten years but suspended the sentence and placed him on probation. The defendant is eighteen years old and does not have any prior criminal convictions. This case was prosecuted by the Polk County Attorney’s Drug and Gang Bureau.

On April 5th, 2012, Shawna Ruby FE252709, came before the court and entered a guilty plea to the offense of Possession of a Controlled Substance with Intent to Deliver, as a lesser included offense of Count II of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(6), a Class C Felony. On May 17th, 2012, she came before the court for sentencing. The State recommended a ten year suspended sentence and probation. The defense argued for a deferred judgment. The court granted her a deferred judgment and probation. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On April 5th, 2012, Ronnie Wells FE252719, entered a plea to the offense of Possession of a Controlled Substance with Intent to Deliver, as a lesser included offense of Count II of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(6), a Class C Felony. On May 17th, 2012, she came before the court for sentencing. The State argued for a ten year suspended sentence and probation. The defense argued for a deferred judgment. The court granted her a deferred judgment and probation. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

05/18/2012

On May 18, 2012, Deanna Jackson pled guilty to the crimes of Possession of a Controlled Substance With Intent to Deliver, a Class C felony, as a second or subsequent offender in case number FE254016, and Possession, Receipt, Transportation or Dominion and Control Over a Firearm as a Convicted Felon, a Class D felony in case number FE245015. She will be sentenced on July 5, 2012 at 9:30 a.m. and faces a maximum indeterminate term of thirty (30) years in prison with a mandatory minimum term of one-third and five (5) years in prison. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On May 18, 2012, James Cook pled guilty to the crime of Possession of a Controlled Substance With Intent to Deliver, a Class B felony, as a second or subsequent offender, in case number FE253750. He was to a maximum indeterminate term of fifty (50) years in prison and must serve a mandatory minimum term of one-third prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Sherri Eder pled guilty to Pimping, Prostitution and Possession of marijuana in FE254598. She admitted she rented a hotel room for herself and another (minor) girl to engage in prostitution. She admitted she solicited a man (later to be identified as police officer) for sex in exchange for money. And she admitted she was in possession of marijuana. She will be sentenced the end of June

On May 18, 2012, Michael Walker pled guilty in Polk County Criminal Number FECR254090 to the crime of Possession of a Controlled Susbstance with Intent to Deliver (Cocaine Base "Crack") as a Habitual Offender. Sentencing was set for a later date. The defendant is being prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Mike Lipcamon has been absconded from probation since 2001, living in various states across the country, most recently Tennessee. Lipcamon appeared for a probation violation hearing in FE148691. He will remain in jail pending the Courts decision on whether to revoke his probation

Timothy Mericle stipulated he violated the terms and conditions of his probation inFE248907. He tested positive for the use of an illegal controlled substance. He will serve 30 days in jail for contempt time and then participate in out patient treatment.

Matthew Dicks stipulated he violated the terms and conditions of his probation in FE247676 and FE241130, a charge of Attempted Burglary 3rd Degree and Felony Failure to Appear. He requested the Court revoke his probation and sentence him to prison for the original term of seven (7) Years.

Adam Damrow stipulated he violated the terms and conditions of his probation in FE249796. He admitted he failed to comply with the majority of the rules of his probation by failing to report to his Probation officer, using illegal substances and failing to comply with programming. He will be sentenced in June. He has asked the Court consider placing him in the Drug Court program.

David Gonzalez successfully completed residential substance abuse treatment at Mt. Pleasant and will be continued on probation with placement at a ½ way house in FE241187.

William Hayes stipulated he violated the terms and conditions of his probation in FE245140. He will serve 30 days in jail for contempt and will then report to his probation officer. He will also be required to complete 15 hours of community service work.

Greg Emory was continued on probation in FE234439 to allow him to continue making payments on his victim restitution.

Natasha Winkleman was continued on probation in FE184872 after getting compliant with all living and reporting requirements with the Department of Corrections.

The Court agreed to modify the bond of Terrance Tyrone Lovelady, Jr. to be in accordance with the bond guidelines. Mr Lovelady was being held on cash only bonds. The Court modified the bonds to cash or surety.
