Weekly Case Summary

On April 30, 2012, Capricael James was sentenced for the crimes of Possession of a Controlled Substance With Intent to Deliver, two counts, a Class C felony and a Class D felony, in case number FECR252385. Judgment was deferred and he was placed on probation for five (5) years. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On March 20th, 2012, Nicole Stuck came before the court and entered a guilty plea to the offense of Possession of a Controlled Substance with Intent to Deliver, as a lesser included offense of Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)( c )(6), a Class C Felony. On May 1st, 2012, she came before the court for sentencing. Both parties recommended a ten year suspended sentence and probation. The court followed the recommendation of the parties. As a condition of probation, the defendant was ordered to complete the treatment program at I.R.T.C. in Mt. Pleasant, Iowa, followed by a halfway house. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Jesse Downs pled guilty in FE253073 to the charge of Burglary 3rd Degree. He admitted he broke into an elementary school in Ankeny and caused damage to the property. He will be sentenced June 13th.

Tammie Dabney was granted a Deferred Judgment in FE242906 on the charge of Fraudulent Practices 2nd Degree. The Court cited her lack of criminal history and the fact that she is currently employed as considerations in determining her sentence. She will be on probation for two (2) years and will be required to pay $1746 in restitution to the State of Iowa.

Trevor Perez was granted a Deferred Judgment in FE251955 on the charge of Burglary 3rd Degree. Mr. Perez is employed full time, admitted his wrong doing and agreed to comply with any programming requested by the Department of Corrections, including obtaining a substance abuse evaluation. He will be on probation for two (2) years and will be required to make $495.02 in restitution to the victim in this case.

Gerald Mullahey pled guilty to Theft 5th Degree in SM326337. He was ordered to pay a fine of $65. A Forgery charge was dismissed.

On May 3, 2012, Jossue Gomez was sentenced to prison in Polk County Criminal Number FECR254260 for a period not to exceed 25 years for the crime of Delivery of a Controlled Susbstance (Methamphetamine). The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
