Weekly Case Summary
12/02/2013

On October 21, 2013, Ana Mikula and Jennifer Kuhlman came before the court and entered a guilty plea to the offense of possession of a controlled substance with intent to deliver, as alleged in count II of the trial information, in violation of Iowa Code Section 124.401(1)(d), a class d felony. On December 2, 2013, both defendants came before the court for sentencing and received a deferred judgment and probation. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On October 21, 2013, Paul Updike, came before the court and entered a guilty plea to the offense of manufacturing a controlled substance, as alleged in count I of the trial information, in violation of Iowa Code Section 124.401(1)(d), a class d felony and Failure to possess a tax stamp, as alleged in count II, in violation of Iowa Code Sections 453B.3 and 453B.12, a class d felony. On December 2, 2013, he came before the court for sentencing and received a ten year suspended sentence and was placed on probation for two years. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On October 21, 2013, Joshua McDonald came before the court and entered a guilty plea to the offense of delivery of a controlled substance, as alleged in count I of the trial information, in violation of Iowa Code Sections 124.401(1)(d), a class d felony. On December 2, 2013, he came before the court for sentencing. The State of Iowa argued for a five year prison sentence. The defendant argued for probation. The court granted him a five year suspended sentence and probation with the condition he reside at the Fort Des Moines Residential Correctional Facility. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On December 3, 2013, Alice Riley appeared for a probation violation hearing. She is on probation for Unauthorized Possession of an Offensive Weapon, a Class D felony, in case number FE261483. The Court found that she had violated the conditions of her probation and the Court revoked her probation and sentenced her to five (5) years in prison. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On October 24, 2013, Dakota Ramirez, came before the court and entered a guilty plea to the offense of Possession of a Controlled Substance with Intent to Deliver-marijuana, as alleged in Count I of the Trial Information, in violation of Iowa Code Sections 124.401(1)(d), a Class D Felony. On December 5, 2013, the defendant came before the court for sentencing and received a deferred judgment and probation. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On December 5, 2013, Richard Feldhacker was sentenced for the crimes of Possession of a Controlled Substance With Intent to Deliver, two counts, a Class C felony and a Class D felony, in case number FE264686. He was sentenced to a maximum indeterminate term of incarceration of ten (10) years with a mandatory one-third term he must serve prior to becoming eligible for parole and five (5) years, consecutive. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On December 5, 2013, Kirk Sackett, came before the court and entered a guilty plea to the offense of possession of a controlled substance with intent to deliver-marijuana, as alleged in count I of the trial information, in violation of Iowa Code Sections 124.401(1)(d), a class d felony, as a second or subsequent offender, in violation of Iowa Code Section 124.411. The defendant waived time and notice and requested immediate sentencing. Prior to the plea the defendant completed a pre-sentence PSI report. The defendant received a 10 year suspended sentence and probation. This case was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Roger Polanco Garza pled guilty in OWOM077002 to Assault on a Peace Officer and OWI 1st Offense. He also stipulated he violated the terms and conditions of hi probation in another matter. He was granted probation and sentenced to remain in jail until there as space available for him at the Fort Des Moines Residential Facility where he will be required to reside.

Weston Bueford pled guilty in AG270913 to Burglary of a Motor Vehicle and Assault Causing Injury . He was granted probation with treatment.

Edward Dipple stipulated he violated the terms and conditions of his probation and was sentenced to prison in FE263757 for a period of five (5) years on the charge of Failure to Comply with the Sex Offender Registry

Brandon Ecker was granted placement at the Fort Des Moines Facility as a condition of his continued probation after stipulating he violated the terms of his probation. He will remain in jail until a bed is available for him

Korey Martz was granted continued probation after violating his probation by failing to work on his GED, failing to pay his court ordered financial obligations and using marijuana. He has to complete 30 hours of community service and work at least 5 hours a week on his GED in FE252721.

Jennifer Turner pled guilty to escape for failing to return to the Fort Des Moines Facility as required in SR269181. She stipulated she violated the terms of her probation in FE261860 by committing this new offense. She was sentenced to prison for five years and given credit on the escape charge for 30 days in jail.

James White stipulated he violated the terms of his probation in FE262689 on the charge of Theft 1st Degree. He was sentenced to prison for 10 years.

On December 6, 2013, Phyllis Oberender appeared for a probation violation hearing. She is on probation for Conspiracy to Deliver a Controlled Substance, a Class C felony, and Failure to Possess a Tax Stamp, a Class D felony, in case number FE253690. The Court found that she had violated the conditions of her probation and the Court revoked her deferred judgment, sentenced her to ten (10) years and five (5) years in prison, consecutive, but suspended this sentence and ordered her to complete in-patient substance abuse treatment. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On December 6, 2013, Gena Rodriguez was sentenced to prison in Polk County Criminal Number FECR264920 for a period not to exceed 25 years for the crime of Conspiracy to Deliver a Controlled Substance (Methampehtamine). The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.
