The following matters were heard before District Court Judge Christopher L. McDonald
on July 31, 2013, in Criminal Courtroom 204:
Motion to Dismiss:
Taylor R. Green appeared before the court on his Motion to Dismiss in FECR265495.
The defendant presented documentation demonstrating the underlying charge which
forms the basis for the new prosecution in FECR265495 was set aside in Warren County
nullifying the elements of this charge. Consequently the charge was dismissed.
Michael Patrick Butler appeared before the court in FECR261223 on the charge of
Theft in the Second Degree as a lesser included Class D. Felony. The defendant entered
a guilty plea which the court accepted. A Presentence Investigation Report was ordered
with sentencing to follow at a later date. At the time of Sentencing, the defendant
is free to request a Deferred Judgment and the State will recommend a Suspended
Sentence and Probation contingent upon the defendant not committing any new offenses
between Plea and Sentencing.
Robert McClish appeared before the court in FECR263521, FECR263991, AGCR266253 and
AGCR266683. The defendant previously pled guilty to Theft in the Second Degree in
FECR263521 and Burglary in the Third Degree in FECR263991 on May 6, 2013. At the
time of sentencing the defendant had picked up 2 new Driving While Barred as a Habitual
Offender in AGCR266253 & AGCR266683. The defendant also entered guilty pleas and
was sentenced in those matters as well. The judgment of the court was the defendant
was adjudged guilty of Theft in the Second Degree and Burglary in the Third Degree.
He was imprisoned for a period not to exceed 5 years on each of those felony counts,
those sentences were to run consecutive to each other and consecutive to his Driving
While Barred as a Habitual Offender in AGCR266253 and AGCR266683, however, the 2
Driving While Barred ran concurrent to each other and the defendant was ordered
to serve a total term of incarceration not to exceed 12 years.
Sean Ryan Wharton appeared for sentencing in FECR263640 on the charge of Theft in
the Third Degree as a lesser included offense. The defendant previously pled guilty
on June 6, 2013. The defendant was adjudged guilty of Theft in the Third Degree
and was ordered to be in prison for a period not to exceed 2 years. The sentence
was suspended and the defendant was placed on probation for 2 years. As specific
terms of probation the defendant shall be required to comply with mental health
and substance abuse treatment. Additionally, the defendant was fined the statutory
minimums and is required to pay any and all restitution.
Andrew D. Scruggs appeared before the court for a guilty plea and sentencing in
FECR266245. The defendant entered a plea of guilty to Attempted Burglary in the
Third Degree as a lesser included offense. The defendant’s plea was accepted. The
defendant was adjudged guilty of Attempted Burglary in the Third Degree and sentenced
to a term of incarceration not to exceed 2 years. The sentence was suspended and
the defendant was placed on probation for a period of 2 years. The defendant received
a $625.00 fine plus a 35% surcharge. The defendant was also ordered to pay restitution.
As a condition of probation, the defendant was to comply with all recommendations
made by the Department of Corrections.
Chelsi Reinier was arraigned in FE267381 on a Theft in the Second Degree charge,
a Class D Felony. The defendant entered a plea of not guilty to all charges. A pretrial
conference and trial date were scheduled.
Adam Miller was arraigned in FE266466 on a Theft in the Second Degree charge, a
Class D Felony. The defendant entered a plea of not guilty to all charges. A pretrial
conference and trial date were scheduled.
Nicholas Kin appeared in Court for a Bond Review. Prior to the hearing, the defendant
withdrew his bond review request and the hearing was cancelled.
Moses Anthony Parker appeared in court for a scheduled guilty plea in FE262510,
an Escape or Absence from Custody charge, a Class D Felony and in FE265955, a Forgery,
Class D Felony charge. He was also scheduled for disposition in FECR249137 and AG247786.
Prior to the guilty plea and disposition hearing, defendant informed the court about
his intent to proceed to trial in FE262510 and FE265955. A trial date in those matters
was set for August 26, 2013 at 9:00am and the deposition hearing in FECR249137 and
AG247786 was continued till the trial date.
Dexter Cheatem appeared in FE224552 and FE242965 for a disposition hearing after
previously situplating that he had violated his probation in both cases. The disposition
was continued till August 16, 2013 at 11:00am
Aaron Wayne Deatherage appeared in FECR247153 for a guilty plea hearing. At the
hearing, the defendant withdrew his plea of not guilty and entered a guilty plea
to Failure To Comply with Sex Offender Registry, a Second or Subsequent Offense.
Sentencing was set for 16th of September 2013 at 9:30am.
Jeremy G. Priester appeared in FECR266143 for a guilty plea hearing. At the hearing,
the defendant withdrew his plea of not guilty and entered a guilty plea to Forgery,
a Class D Felony. Sentencing was set for 16th of September 2013 at 9:30am.
Roberto Martinez, Jr. appeared in FECR259632 and SR25923 for a guilty plea hearing.
At the hearing, the defendant informed the court that he intends to proceed to trial
in both cases. A trial date of October 28, 2013 was set.
