On December 30, 2011, Defendant Daniel A. Moss, entered a plea of guilty to the charge of: Possession of a Controlled Substance with Intent to Deliver, to wit: marijuana as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). On April 23, 2012, Defendant Daniel A. Moss, was sentenced to a period of incarceration not to exceed 5 years for the charge of: Possession of a Controlled Substance with Intent to Deliver, to wit: marijuana, as alleged in the Trial Information, a Class D Felony, in violation of Iowa Code Section(s) 124.401(1)(d). The sentence in this matter was deferred and the defendant was placed on probation for two years. Daniel A. Moss was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On March 6, 2012, Defendant Nicole Guenther, entered a plea of guilty to the charge of: Conspiracy to Manufacture a Controlled Substance, to wit: methamphetamine as alleged in the Trial Information, a Class C Felony, in violation of Iowa Code Section(s) 124.401(1)(c)(6). On April 23, 2012, Defendant Nicole Guenther, was sentenced to a period of incarceration not to exceed 10 years for the charge of: Conspiracy to Manufacture a Controlled Substance, to wit: methamphetamine, as alleged in the Trial Information, a Class C Felony, in violation of Iowa Code Section(s) 124.401(1)(c)(6). The sentence in this matter was deferred and the defendant was placed on probation for two years. Nicole Guenther was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

State of Iowa v. Matthew Moore – FECR254951 – This defendant was arraigned on the charge of Burglary in the Third Degree and entered a plea of Not Guilty. A Pre-trial Conference was scheduled for May 31, 2012, at 2:00 p.m., in room 204 and Trial was set for June 27, 2012.

State of Iowa v. Steven Taylor – FECR254969 – This defendant was arraigned on the charge of Theft in the Second Degree and entered a plea of Not Guilty. A Pre-trial Conference was scheduled for May 31, 2012, at 2:15 p.m., in room 204 and Trial was set for June 27, 2012.

State of Iowa v. Kevin Owen – FECR254748 – This defendant was arraigned on the charge of Burglary in the Second Degree and entered a plea of Not Guilty. A Pre-trial Conference was set for May 24, 2012, at 2:00 p.m., in room 204, and Trial was set for June 25, 2012.

State of Iowa v. Nicholas Griffin – FECR254004 – This defendant was arraigned on the charge of Theft in the Second Degree and entered a plea of Not Guilty. A Pre-trial Conference was set for May 10, 2012, at 2:30 p.m., in room 204, and Trial was set for June 6, 2012.

State of Iowa v. Shawn Carlson – FECR254581 – This defendant was arraigned on the charges of Possession of a Controlled Substance – Third or Subsequent Offense and entered a plea of Not Guilty. A Pre-trial Conference was scheduled for May 31, 2012, at 2:45 p.m., in room 207. Trial was set for June 27, 2012.

State of Iowa v. Johnna Waddell – FECR245088 – A hearing was held regarding the disposition of the Defendant’s probation violations following her failure to successfully complete treatment and the Women’s facility. The Court ordered that the Defendant’s Deferred Judgment be revoked and that a Prison sentence be imposed. The Defendant had been on probation after pleading guilty to Forgery, a Class D Felony, and was therefore ordered to serve a term of incarceration not to exceed five (5) years. The Defendant was ordered to the custody of the Iowa Department of Corrections and will be transferred to Oakdale to begin her sentence. The Defendant also pled guilty to Escape – SRCR254889. The charge arose out of the Defendant leaving the Women’s facility without permission and being gone for several days. The charge is a Serious Misdemeanor and the Defendant was ordered to serve thirty-seven (37) days in the Polk County Jail and given credit for thirty-seven (37) days that she had already served.

State of Iowa v. Scott Henderson – FECR248921 – This Defendant appeared for Sentencing after pleading guilty on March 13, 2012, to Fraudulent Practices in the Second Degree, a Class D Felony. The Court granted the Defendant a Suspended Sentence and placed him on two (2) years of probation to be supervised by the Fifth Judicial District Department of Corrections. The Defendant was also ordered to pay a fine in the amount of $750 plus 35% surcharge. The Defendant was ordered to pay other costs and fees associated with his probation and ordered to comply with any terms or conditions set forth by the Probation Department.

Richard Allen Moore was sentenced on a single count of child endangerment in FE249779. He was granted probation with several term and conditions, including that he comply with DHS programming regarding his child.

Tremeshia Holder was continued on probation in FE225824. Although she obtained her GED as directed, she still owes financial obligations. The law requires she enter into a payment plan or fulfill her court ordered financial obligations before she can be discharged from probation.

Tararez Harper Jr. was denied a modification to his bond in FE253114. He had previously pled guilty and is awaiting sentencing. Although the Department of Corrections Pre-Trial Release program would supervise him on release, the Court denied his release as he is not in school and cannot return to his prior school, he has no job and no current prospects for a job. The Court determined he was not a good candidate to be released with no supervised or accounted for time.

Emilio Cosimo was granted a Deferred Judgment in FE250861 on the charge of Fraudulent Practice 1st Degree. He admitted he had received unemployment benefits fraudulently by not reporting that he was a subcontracting. He owes nearly $10,000 in restitution and will be on probation for two years.

Jason Robert Fox was sentenced to prison on Burglary 3rd Degree and Voluntary Absence. He had previously been admitted to the Youthful Offender Program in FE249484. He was Court ordered to the Fort Des Moines Residential Facility. He absconded that facility and was was subsequently revoked from the Youthful Offender Program. The two sentences will be served consecutively to each other for a term not to exceed six (6) years.

Randy Weatherman pled guilty in FE252731 to the charge of Theft 1st Degree. He will be sentenced in June. The Defendant admitted he took money from his company in the amount of $30,000 and used it for his own purposes. He met with the victim during a VORP session and expressed his remorse. He will begin making the restitution payments immediately.

Angela Frees was sentenced to probation in FE252239. She had previously admitted she shoplifted from Von Maur and engaged her pre-teen children to do the same. The Court denied her request for a deferred judgment citing the seriousness of this offense as well as the fact that she had been granted a deferred judgment in a matter several years ago and was unsuccessful with that probation. She will be supervised for two years by the Department of Corrections. If she violates her probation, she is subject to ten (10) years in prison.

Jesse Dee Souder pled guilty in FE252387 to the charge of Arson 2nd Degree. Mr Souder admitted he set fire to an apartment he was living in because he wanted to see the fire. He will remain in jail pending sentence or placement in an appropriate mental health facility.

On April 26, 2012, Noble Griffin was sentenced to an indeterminate term of incarceration not to exceed 10 years in Polk County Criminal Number FECR251868 for the crime of Delivery of a Controlled Substance (Cocaine Base Crack). The Court granted Noble Griffin a suspended sentence and placed him on probation for a period of two years. The defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

On April 26, 2012, Joseph Anderson plead guilty to the crimes of Possession of a Controlled Substance With Intent to Deliver, two counts, a Class B felony and a Class C felony, and admitted that he is an habitual offender, in case number FECR247808. He was sentenced to maximum indeterminate terms of twenty-five (25) years and fifteen (15) years in prison, consecutive for a total term of forty (40) years, and must serve a mandatory one-third minimum of this sentence prior to becoming eligible for parole. This defendant was prosecuted by the Polk County Attorney’s Office Drug and Gang Bureau.

Richard S. Baker was arraigned in FE254590 on Count I: Possession of a Controlled Substance with Intent to Deliver, a Class D Felony; Count II: Conspiracy to Deliver a Controlled Substance a Class D Felony and Count III: Failure to possess a Tax Stamp, a Class D Felony. The defendant entered a plea of not guilty to all charges. A pretrial conference and trial date were scheduled.

Kenna L. Baker was arraigned in FE254591 on Count I: Possession of a Controlled Substance with Intent to Deliver, a Class D Felony; Count II: Conspiracy to Deliver a Controlled Substance a Class D Felony and Count III: Failure to possess a Tax Stamp, a Class D Felony. The defendant entered a plea of not guilty to all charges. A pretrial conference and trial date were scheduled.

Rubben D. Jackman, was arraigned in SR254763 on Possession of a Controlled Substance with Intent to Deliver, a Class D Felony; Count II: Failure to possess a Tax Stamp, a Class D Felony. The defendant entered a plea of not guilty to all charges. A pretrial conference and trial date were scheduled.

Rubben D. Jackman, JR was arraigned in SR254762 on two counts of Possession of a Controlled Substance, a Serious Misdemeanor. The defendant entered a plea of not guilty to all charges. A pretrial conference and trial date were scheduled.

Belinda A. Clark was arraigned in FE254576 on Count I: Burglary in the 3rd Degree, a Class D Felony. The defendant was also charged with Criminal Trespass, a Simple Misdemeanor. The defendant entered a plea of not guilty to all charges. A pretrial conference and trial date were scheduled.

Amy Lavigne appeared for a Status hearing in FE249793 on one charge of Child Endangerment causing serious injury. At the Status hearing, the State dismissed the charge with court cost to the defendant.

Mark Barber appeared before the court for a bond review in FE255482. After hearing arguments from counsel, the court left the bond as previously det.

Randi Beveridge appeared before the court for sentencing in FE251313. The defendant had previously pled guilty to three Class D Felony counts of Forgery on March 8, 2012. She received a defendant received a deferred judgment with the condition that she obtain a new substance abuse evaluation, she continue participation in mental health treatment as recommended and that she participate in other programs as recommended by her assigned probation officer.

Dena Whisler appeared before the court for a probation revocation hearing. This matter was continued till June 4, 2012.

Rusty Shiplet was scheduled in FE227847 and FE220685 to appear to contest jail fees. However, this matter was resolved prior to the motion was heard and the hearing was cancelled.

Tisha Wallace appeared for a probation revocation hearing in FE247271 and FE251457. The matter was continued till May 16, 2012 at 9:00am to allow determine if the defendant qualifies for the Women’s residential treatment
